29A-3-1203 . Succession to real property by affidavit. Sixty days after the death of a decedent, any person claiming to be a successor to the decedent's interest in real property in this state may file, or cause to be filed on their behalf, an affidavit describing the real property owned by the decedent and the interest of the decedent in the property.

What this means: A route the personal-property affidavit (§ 29A-3-1201) does not cover: title to a decedent's South Dakota real property (interest of $50,000 or less) is perfected by an affidavit filed with the register of deeds sixty days after death, rather than by any court filing. Enacted SL 2022, ch 89.
